1. Operator and scope

GiftEngine is operated by Dawid Kuprowski, an individual based in Poland ("GiftEngine", "we", or "us"). You can contact us at support@giftengine.net.

These terms govern your use of giftengine.net, app.giftengine.net, the GiftEngine desktop application, and associated hosted services and widgets. They also set out the end-user licence for the desktop application. Our Privacy Policy explains personal data processing, and our Refund Policy explains cancellation, withdrawal, and refunds.

Where a purchase is made through Paddle, Paddle's purchase terms apply to the transaction, while these terms govern the GiftEngine product. Nothing here overrides mandatory consumer rights.

2. Availability and eligibility

GiftEngine is available for Windows through our official GitHub releases. You can download the application and use the Free plan without purchasing Pro. Pro subscriptions can be purchased only in the GiftEngine desktop application, not on this website.

You must be at least 18 years old and have legal capacity to enter into the applicable agreement. If you use GiftEngine for an organisation, you must have authority to act on its behalf. You must also meet the eligibility requirements of connected platforms.

Features marked "coming soon" are not available deliverables and are not a promise of a particular release date. Check the current feature description, plan limits, and release notes for the version you use.

3. The product and plans

GiftEngine is Windows desktop software with connected services for TikTok LIVE streamers. It connects live events to configured actions and provides features such as presets, stream statistics, sound playback, text-to-speech, widgets, and supported game integrations, depending on availability and plan.

The pricing page describes the Free and Pro plans and their feature limits. Text-to-speech is included in both Free and Pro; no Pro subscription is required for this feature. Pro provides additional application features and higher limits; it is not a purchase of TikTok coins, gifts, viewers, engagement, or in-game assets. GiftEngine does not transfer viewers' funds, accept bets, or provide monetary prizes.

The GTA 5 Chaos Mod is developed by GiftEngine and is free without a Pro subscription. It is for single-player use only, not GTA Online or FiveM. GTA 5 is not included and must be obtained separately. The Minecraft Plugin is currently marked as coming soon.

You are responsible for a compatible Windows device, internet access, and any required platform accounts, games, permissions, and third-party software. GiftEngine cannot guarantee viewer numbers, gifts, revenue, or uninterrupted availability of third-party services.

4. Licence and permitted use

Subject to these terms and your access rights, we grant you a limited, non-exclusive, non-transferable licence to install and use GiftEngine for your own streaming activities, including commercial streams, within the applicable plan limits. The software is licensed, not sold; no ownership of GiftEngine's intellectual property is transferred.

You must not resell or sublicense access, bypass authentication or plan limits, interfere with the security or availability of the service, or use it to infringe another person's rights. Restrictions do not override uses expressly permitted by applicable law or rights granted under third-party open-source licences.

You retain your rights in content you provide. You permit us to process that content only as needed to provide the service you request. You must have the rights needed to use uploaded sounds, messages, and other content and to direct their playback or processing.

5. Accounts and connected platforms

Provide accurate account information, protect your sign-in credentials, and notify us if you suspect unauthorised access. Do not use another person's account without permission or provide credentials or secrets through public content or support messages.

You are responsible for your stream configuration, actions triggered by your integrations, and compliance with applicable platform and game rules. Do not use GiftEngine for unlawful content, harassment, unauthorised data access, artificial engagement, or other prohibited activity.

GiftEngine is an independent product and is not affiliated with, endorsed by, or sponsored by TikTok, Rockstar Games, Mojang, or Microsoft. Their names and marks belong to their respective owners. Third-party services may change or discontinue functionality outside our control.

External services are used for features such as sign-in and speech generation. Their relevant data processing is described in our Privacy Policy.

6. Purchases and recurring billing

Pro purchases are initiated only within the GiftEngine desktop application. For orders placed through Paddle, Paddle acts as our authorised reseller and Merchant of Record. The applicable Paddle selling entity is identified in its checkout and Buyer Terms.

Paddle handles payment collection, applicable transaction taxes, invoicing, and payment-related support and refunds. GiftEngine remains responsible for the application, access to its features, and technical support.

Pro is a monthly recurring subscription. Prices and limits are shown on the pricing page and at checkout. Unless stated otherwise, advertised prices exclude taxes; applicable taxes and the total payable are displayed before you confirm a purchase.

A subscription renews automatically for successive monthly billing periods until cancelled. You authorise the recurring charges disclosed at checkout. Downloading the application, creating a Free account, or viewing the pricing page does not create a paid subscription or authorise a charge.

If a free trial is offered, its duration, eligibility, price after the trial, and the timing of any recurring charges are shown before you confirm it. Cancel before the trial ends to avoid the next charge under the terms shown at checkout.

Material billing or price changes will be communicated before they take effect as required by applicable law, with an opportunity to cancel before a future charge. If a payment fails, paid access may be affected; payment questions should be addressed through Paddle.

7. Cancellation, withdrawal, and refunds

You may cancel a paid subscription through the Paddle Customer Portal linked in your transaction email or by requesting cancellation at paddle.net. Ordinary cancellation takes effect at the end of the current paid billing period, prevents future renewals, and allows access until that period ends.

Cancellation is separate from a statutory withdrawal or refund request. Refund eligibility is governed by applicable law, Paddle's applicable purchase and refund terms, and our Refund Policy. We do not offer a separate unconditional money-back guarantee.

To request deletion of your GiftEngine account and its associated data, email support@giftengine.net. If a paid subscription exists, also cancel it through Paddle; do not rely on an account deletion request alone to stop recurring charges.

8. Support and complaints

For application issues, access problems, or complaints about GiftEngine, email support@giftengine.net. Describe the issue, the affected account, and the resolution you seek, without including passwords or payment card details. We will handle complaints within the deadlines required by applicable law.

For charges, receipts, subscription management, or payment refunds, contact Paddle support. A technical issue should first be reported to GiftEngine so we can try to resolve it. This does not restrict any right to contact Paddle or seek a remedy under applicable law.

9. Suspension and ending access

We may restrict access where reasonably necessary to address a material breach of these terms, a security threat, unlawful activity, or a legal requirement. Where lawful and practicable, we will explain the reason and provide an opportunity to resolve it. Urgent protective action may be taken without advance notice.

Ending access does not automatically remove any right to a refund or other remedy. If we discontinue a paid service, applicable consumer rights and remedies for the unused or undelivered service remain available.

10. Consumer rights and responsibility

GiftEngine is provided with the functionality described for the applicable version and plan. Reliance on third-party services does not exclude any mandatory rights concerning conformity, defects, delivery, or remedies.

Nothing in these terms excludes or limits responsibility that cannot lawfully be excluded or limited, including liability for intentional misconduct or other liability protected by mandatory law. You remain entitled to remedies provided by applicable law.

11. Applicable law and changes

These product terms are governed by Polish law, without depriving consumers of mandatory protections available under the law of their habitual residence. Any dispute may be brought before the courts competent under applicable law. Paddle's transaction terms have their own applicable-law provisions.

We may update these terms to reflect changes in the service, legal requirements, or security needs. Material changes will be communicated before they take effect where required, and any consent or right to terminate required by law will be respected. Changes do not retroactively remove accrued rights or alter completed purchases.
